HSPRD attorneys Christopher Wilmes and Mary Rowland, along with the Chicago Lawyers' Committee For Civil Rights Under Law, filed a class action complaint against background check company Infotrack Information Services, Inc.

The complaint alleges that Infotrack has repeatedly provided criminal background check reports to employers inaccurately stating that job applicants are sex offenders. Though the firm’s client is white and in his twenties, Infotrack wrongly connected him with three different African-American sex offenders, two of whom are in their fifties or sixties, and communicated that information to an employer. The complaint alleges that Infotrack did not implement reasonable procedures to ensure the maximum possible accuracy of information in its reports, in violation of the Fair Credit Reporting Act.
